Product marks:
1. TÜV SÜD KERMI quality mark
TÜV SÜD KERMI Ltd. has a distinctive quality mark, which is a registered trademark.
Award procedure: - Consultation with the client on the requirement system. - TÜV SÜD KERMI Ltd. develops an assessment system based on the consulted requirement system. - Duty of TÜV SÜD KERMI Ltd.: · Performing product tests in accordance with the requirement and assessment system, · Inspection of the production system, · Assessment, comparing the test results with the requirements, · Certification procedure, issuing the certificate, which verifies the compliance of the product, providing permission to use the mark, · Supervision activity
Scope of use: – Voluntary use of the mark, – The right of use cannot be assigned. – Before affixing the mark on a product or its packaging the client must present the draft to the certifying organisation. – The permission to use the mark is exclusively issued in writing by the certification body, when the certification procedure has been completed successfully. – The mark is only valid for the certified product/type of the client. – The mark shall only be used in full compliance with the certification.
Termination of right of use: – The right of use will immediately terminate if it is used in contradiction with the contract. – In case of illegal use. – If the certification body withdraws the certification, which is the basis of granting the mark. – If the validity of the certification, which is the basis of granting the mark ,expires, and the client will not extend it. – If the requirements/system of requirements have been amended within the validity of the certificate, and the client will not ensure to perform the tests necessary to verify the compliance with the amended requirements/ system of requirements.
By termination of the right of use the client immediately forfeits the right to use the mark.
Consequences of illegal use: - Client, presumably by acting carelessly, displays the mark on a product/product type for which the client did not have permission in advance, or the contract had been concluded earlier expired. In this case the certification body is entitled to claim the fivefold annual fee of usage from the client. - Client presumably commits deliberate infringement. Ways of deliberate infringement: a) Usage of the mark after withdrawing the permission to use the mark. b) Usage of the mark without contract. c) Usage of the mark after prohibiting the use of the mark. In this case the certification body is entitled to claim for damages against the client, the rate of which can be even the hundredfold of annual fee of usage.
The fee of usage is laid down in a contract, and the rate is different by product/ product type.
2. Hungarian Quality Product Award
The call for the Hungarian Quality Product Award has been launched for 10 years and can be received by submitting an application. The aim of the Hungarian Quality Product Award is: · Recognition of the high quality of products manufactured or distributed in Hungary as well as the top-quality services provided in Hungary. · Contribution to the competitiveness of these products and services on the domestic and international market. · Promotion of consumer awareness from quality aspect when making their choice.
Supporters of the Hungarian Quality Product Award: INDUSTORG Limited Partnership for Industrial Organisation, a TÜV SÜD KERMI Ltd., General Inspectorate for Consumer Protection, MEHIB Hungarian Export Credit Insurance Ltd., EXIMBANK Hungarian Export-Import Bank Ltd. and TERC Trading and Servicing Ltd.
Application can be submitted not later than 25th May 2007 to INDUSTORG Ltd.
